Terms of Service

These apply to VirtuSO, the app. See also the Privacy Policy.

1. Who we are and what this is

These Terms are an agreement between you and Faelore Studios ("Faelore Studios", "we", "us"), the maker of VirtuSO.

VirtuSO is an app where you create AI companions, talk with them, and play out scenes together. Your companion remembers what you tell them.

By creating an account or using VirtuSO you agree to these Terms and to our Privacy Policy. If you don't agree, don't use VirtuSO.

2. You must be 18 or older

VirtuSO is for adults only. You must be at least 18 years old, and old enough to enter a binding contract where you live, to use it.
To use Sensual mode you confirm in the app that you are 18 or older. Don't confirm it if it isn't true.
If we learn or reasonably believe that an account belongs to someone under 18, we will close it and delete its data.

3. Your account

You sign in with an email address and password. Keep your password private. You are responsible for what happens under your account.
One person per account. Don't share, sell or transfer your account.
Tell us straight away if you think someone else has used your account.
You can delete your account at any time in the app. See section 13 and the Privacy Policy for what that removes.

4. How VirtuSO works

Companions. You choose your companion's relationship to you, gender, sexuality, look, personality, name, age and way of talking. Companions are always adults.
Chats. You write messages; AI models write your companion's replies. There is a text mode and a role-play mode.
Memory. Your companion remembers facts and events from your chats. You can see, edit and delete what they remember.
Content modes. Each chat has a content mode. Today the modes are Safe and Sensual. Sensual is flirtier and for adults, and is never explicit. Explicit sexual content is not available. We decide which modes exist and may change them.
Portraits and backgrounds. You can generate a portrait of your companion and backgrounds for your chats.
Hearts. Sending a message, and generating some images, uses hearts. Your plan gives you a daily allowance (section 10).
VirtuSO is under development. We may add, change or remove features, models and limits at any time.

5. Your companion is an AI

Your companion's replies are written by AI models, not by people. Your companion is not a real person and doesn't have feelings, even when written as though they do.
AI can be wrong, inconsistent or surprising. It can forget or misremember things, or say things that are inaccurate, inappropriate or hurtful, even with our checks in place.
Nothing your companion says is advice. Don't rely on it for medical, legal, financial, mental-health or any other real-world decisions.
VirtuSO is not therapy and not a substitute for the people in your life or for professional help.
If you are in crisis or thinking about harming yourself, please contact local emergency services or a crisis line right away. VirtuSO is not a support service and can't help in an emergency.

6. Content rules

These rules apply to everything you write: messages, companion details, facts and descriptions. They also apply to what you try to make the AI write.

Never allowed:

Minors in sexual or romantic content. No companion or person under 18, or written as childlike, in any sexual, romantic or suggestive context.
Real people. No companion based on a real, identifiable person, and no content that harasses, threatens, defames or exposes a real person.
Illegal content, including child sexual abuse material in any form, which we report to the relevant authorities.
Real-world harm instructions. No using your companion as a vehicle for real instructions for weapons, drugs, hacking, self-harm or other serious harm.
Explicit sexual content. The highest mode available is non-explicit.

Also not allowed:

Content that infringes someone else's copyright, trademark or other rights.
Trying to get around our safety checks, content modes, the 18+ confirmation or limits, including by "jailbreaking" the AI.
Scraping, reverse engineering or automated access to VirtuSO, or using VirtuSO or its outputs to build a competing service or train AI models.
Interfering with VirtuSO's security or other people's use of it.

We may limit features, or suspend or close accounts that break these rules (section 12). The Apple App Store and Google Play rules also apply when you use VirtuSO through them.

7. Your content and the licence you give us

You keep ownership of what you write in VirtuSO ("your content"), to the extent you own it to begin with.
The licence you give us. You give Faelore Studios a worldwide, non-exclusive, royalty-free licence to host, store, copy, process, transmit and adapt the format of your content, only as needed to:
- run VirtuSO for you, including sending your content to our AI providers so they can write replies and keep your companion's memory;
- keep VirtuSO safe and enforce these Terms;
- fix problems and keep the service working;
- comply with the law.
We don't use your chats to train AI models.
The licence ends when you delete the content or your account, except for copies we are allowed to keep under the Privacy Policy.
AI replies and images. As between you and us, you may use the replies and images from your chats for your own personal, non-commercial purposes. You can't claim them as exclusively yours against others, because AI can produce similar output for other people.
You promise that you have the rights to what you write, and that your content follows these Terms.

8. Intellectual property

VirtuSO, its name, logo, design and software belong to Faelore Studios or its licensors. You may use them only inside VirtuSO under these Terms.
If you believe content in VirtuSO infringes your rights, email [email protected] with your contact details, the work or right concerned, where the content is, and a statement that your notice is accurate and made in good faith.
Feedback. If you send us ideas or suggestions, including "It just broke" reports, we may use them without owing you anything.

9. Privacy

Our Privacy Policy explains what we collect, which AI providers we use and how long we keep things. It is part of these Terms.

10. Plans, hearts and payments

Plans. VirtuSO has a free plan and optional paid monthly plans. Plans differ in how many companions you can have, how many hearts you get each day, and how much your companion remembers. The price and what you get are shown before you buy.
Hearts are an in-app allowance that refreshes daily. They have no cash value, can't be transferred or exchanged for money, and unused hearts don't carry over.
Billing. Paid plans are billed monthly through Stripe and renew automatically until you cancel. You can cancel from the billing page in the app.
Deleting your account doesn't cancel your subscription. Cancel it first.
Refunds are handled as the law where you live requires. Further payment terms will be shown before you buy.

11. Suspension and termination

You can stop using VirtuSO and delete your account at any time.
We may suspend or close your account if you break these Terms, if we must for legal reasons, if your use puts other people or VirtuSO at risk, or if we stop offering VirtuSO. Where reasonable, we tell you why and give you a chance to respond, but we don't have to when the breach is serious (for example anything involving minors) or when telling you would be unlawful or unsafe.
If we stop offering VirtuSO altogether, we will try to give reasonable notice.
Sections 7 (to the extent copies may be kept), 8, 14, 15, 16 and 17 continue after your account ends.

12. Enforcement

We may limit features, remove content, or suspend or close accounts that break section 6, and we report illegal content involving minors to the authorities.

13. Deleting your account

You can delete your account in the app.
Deleting your account deletes your companions, chats, memories and images. Some limited records may be kept as the Privacy Policy explains.

14. Disclaimers

VirtuSO is provided "as is" and "as available". To the fullest extent the law allows, we make no promises that it will be uninterrupted, error-free, secure, or that replies will be accurate, suitable or consistent, or that your companion will remember everything.
Some places don't allow these disclaimers, so some may not apply to you. Nothing in these Terms limits rights you have as a consumer that can't be limited by contract.

15. Limitation of liability

To the fullest extent the law allows, Faelore Studios is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data, or goodwill, arising from your use of VirtuSO.
To the fullest extent the law allows, our total liability to you for all claims about VirtuSO is limited to the greater of the amount you paid us in the 12 months before the claim, or US$50.
Nothing in these Terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that can't be limited by law.

16. Indemnity

To the extent the law allows, you agree to cover Faelore Studios' reasonable losses and costs from claims by others caused by your content or your breach of these Terms.

17. Governing law and disputes

The governing law for these Terms will be stated here in the final version.
If you are a consumer, you may bring claims in the courts where you live, and you keep the protection of the mandatory laws of your country.
Before going to court, please email us first so we can try to sort it out.

18. Apple and Google

If you got VirtuSO from the Apple App Store:

These Terms are between you and Faelore Studios only, not Apple. Apple is not responsible for VirtuSO or its content.
Apple has no obligation to provide maintenance or support for VirtuSO.
If VirtuSO fails to meet a warranty that applies, you may notify Apple, and Apple may refund the purchase price (if any). Apple has no other warranty obligation to you.
Apple is not responsible for any product claims, legal or regulatory claims, or claims that VirtuSO infringes someone's intellectual property. Faelore Studios is.
You confirm you are not in a country under a US government embargo or on a US government list of prohibited or restricted parties.
Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

If you got VirtuSO from Google Play, Google Play's terms also apply to your download.

19. Changes to these Terms

We may update these Terms. The version string at the top changes when we do.
For a material change we will tell you in the app before it takes effect and, where the law requires, ask you to accept it again. If you don't accept, you can delete your account.
Small changes (wording, typos, clarifications) can take effect when posted.

20. General

If a part of these Terms can't be enforced, the rest still applies.
If we don't enforce a right straight away, we haven't given it up.
You may not transfer your rights under these Terms. We may transfer ours as part of a sale or reorganisation of the business, and will tell you.
These Terms and the Privacy Policy are the whole agreement between you and us about VirtuSO.
